How Bail Bonds Work in Florida

If someone you love has been arrested, this guide walks you through exactly what happens from arrest to release — in plain language, no legal jargon.

01

Arrest & Booking

When someone is arrested in Florida, they're taken to the local jail for booking. This process — fingerprinting, mugshot, recording charges — typically takes 2–6 hours. The defendant cannot be bailed out until booking is complete.

02

Bond Is Set

A judge sets the bail amount at first appearance (usually within 24 hours of arrest). Bond amounts vary widely based on charge severity, criminal history, flight risk, and community ties. Felonies typically range from $5,000 to $100,000+. DUIs often range from $500 to $10,000.

03

Contact a Bail Bondsman

You contact Big Mike's Bail Bonds. We verify the booking number, jail name, bond amount, and defendant information. We walk you through the paperwork and what's needed to post bond.

04

Pay the 10% Premium

Florida law sets the bail bond premium at exactly 10% of the total bond. This is non-refundable — it's the fee for Big Mike to guarantee the full bond amount to the court. Payment plans are available.

05

Bond Is Posted

Big Mike posts the bond directly with the jail. Most Palm Beach County releases process within 1–4 hours after posting. Broward and Miami-Dade may take slightly longer.

06

Defendant Is Released

The defendant is released on the conditions of bond — they must appear at all court dates, stay in the area, and may have check-in requirements. The co-signer is responsible for ensuring compliance.

07

Court Dates

The defendant must appear at every scheduled court date. Missing a court date (FTA — Failure to Appear) triggers a bench warrant and bond forfeiture. Big Mike may then use a bail enforcement agent to locate the defendant.

08

Case Resolved

Once the case is resolved — dismissed, acquitted, or sentenced — the bond is exonerated. The court releases Big Mike's obligation. The 10% premium you paid is not returned; that's the cost of the service.
